Sh\u00ebnohet k\u00ebshtu p\u00ebr her\u00eb t\u00eb par\u00eb nj\u00eb praktik\u00eb administrative n\u00eb qytetin e Kamz\u00ebs n\u00eb fush\u00ebn e t\u00eb drejt\u00ebs p\u00ebr informim, duke d\u00ebnuar me gjob\u00eb pap\u00ebrgjegjshm\u00ebrin\u00eb e zyrtar\u00ebve t\u00eb bashkis\u00eb.<\/span><br \/><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Ligji nr. 119\/2014 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit\u201d \u00ebsht\u00eb konsideruar si <span style=\"color: #003366\"><a style=\"color: #003366\" href=\"http:\/\/www.respublica.org.al\/wp-content\/uploads\/2019\/01\/E-drejta-e-informimit-2018-Res-Publica-CRD.pdf\">ligji m\u00eb i mir\u00eb i renditur i gjashti n\u00eb bot\u00eb<\/a><\/span>, pasi revolucionarizon m\u00ebnyr\u00ebn e aksesit n\u00eb informacionet shtet\u00ebrore\/publike nga ana e qytetar\u00ebve n\u00eb nj\u00eb koh\u00eb t\u00eb reduktuar ( nga 40 dit\u00eb me ligjin e vjet\u00ebr, n\u00eb 10 dit\u00eb pune me ligjin e ri) pa qen\u00eb nevoja q\u00eb t\u00eb\u00a0 shpjegohen arsyet apo t\u00eb motivohet k\u00ebrkesa e d\u00ebrguar ndaj cilitdo institucion.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Grupi i aktivist\u00ebve ATA, q\u00eb vepron dhe punon prej m\u00eb shum\u00eb se 5 vitesh n\u00eb Kam\u00ebz, p\u00ebr shkak t\u00eb aktivitetit t\u00eb tij shum\u00ebdisiplinor (ligj, gazetari, kultur\u00eb) ka d\u00ebrguar vazhdimisht k\u00ebrkesa p\u00ebr informacion pran\u00eb bashkis\u00eb. K\u00ebto k\u00ebrkesa, mb\u00ebshtetur n\u00eb ligjin p\u00ebr t\u00eb drejt\u00ebn e informimit kan\u00eb qen\u00eb t\u00eb fushave t\u00eb ndryshme, nd\u00ebr t\u00eb tjera informacione bazike mbi takimet dhe konsultimet publike, mbledhjet dhe vendimet e k\u00ebshillit bashkiak t\u00eb Kamz\u00ebs, marr\u00ebveshjet dhe kontratat e lidhura mes bashkis\u00eb dhe subjekteve private, kalendar\u00ebt e aktiviteteve kulturore, investimet infrastrukturore n\u00eb qytet etj.<\/span><br \/><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Pavar\u00ebsisht k\u00ebmb\u00ebnguljes s\u00eb grupit ATA p\u00ebr t\u00eb aksesuar informacione q\u00eb pa t\u00eb drejt\u00eb jan\u00eb mohohuar n\u00eb koh\u00eb, tendenca e bashkis\u00eb, Koordinatorit t\u00eb s\u00eb Drejt\u00ebs p\u00ebr Informim si dhe personave p\u00ebrgjegj\u00ebs p\u00ebr protokollimin e k\u00ebrkesave t\u00eb qytetar\u00ebve ka qen\u00eb neglizhuese e mohuese duke keqp\u00ebrdorur t\u00eb gjitha hap\u00ebsirat ligjore apo leht\u00ebsirat e krijuara pas seancave d\u00ebgjimore t\u00eb zhvilluara n\u00eb prani t\u00eb Komisionerit p\u00ebr t\u00eb drejt\u00ebn e Informimit, duke mohuar n\u00ebp\u00ebrmjet vones\u00ebs apo refuzimit nj\u00eb nga t\u00eb drejtat kushtetuese t\u00eb njeriut: e drejta p\u00ebr t\u2019u informuar.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Me dat\u00eb 21 shkurt t\u00eb vitit 2019, Grupi ATA i drejtohet bashkis\u00eb Kam\u00ebz me k\u00ebrkes\u00ebn p\u00ebr informacion mbi nj\u00eb nga ngjarjet m\u00eb t\u00eb ndjeshme mjedisore p\u00ebr banor\u00ebt e Laknasit, tjet\u00ebrsimit dhe dh\u00ebnies me qera t\u00eb zon\u00ebs pyjore \u201cPlepat e Bruk\u00ebs\u201d ndaj nj\u00eb subjekti tregtar, q\u00eb kishte q\u00ebllime biznesi. Objekt i k\u00ebrkes\u00ebs ishte v\u00ebnia n\u00eb dispozicion t\u00eb vendimit t\u00eb k\u00ebshillit bashkiak me t\u00eb cilin zona e ashtuquajtur \u201cPlepat e Bruk\u00ebs\u201d i jepej me qera nga Bashkia Kam\u00ebz subjektit privat tregtar \u201cBIOPRODUCTS\u201d shpk, si dhe bashkangjitur nj\u00eb kopje e kontrat\u00ebs s\u00eb qiras\u00eb mes kryetarit t\u00eb bashkis\u00eb Xhelal Mziut dhe subjektit \u201cBIOPRODUCTS\u201d shpk.<\/span><br \/><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Rreth dy muaj m\u00eb pas, m\u00eb 24 prill, p\u00ebr shkak t\u00eb pamund\u00ebsis\u00eb p\u00ebr t\u00eb siguruar informacionin e k\u00ebrkuar n\u00eb rrug\u00eb zyrtare q\u00eb me k\u00ebrkes\u00eb t\u00eb par\u00eb, rip\u00ebrs\u00ebritet k\u00ebrkesa me t\u00eb nj\u00ebjtin objekt duke k\u00ebrkuar vendimin e k\u00ebshillit bashkiak p\u00ebr miratimin e dh\u00ebnies me qira t\u00eb zon\u00ebs pyjore \u201cPlepat e Bruk\u00ebs\u201d si dhe kopje e kontrat\u00ebs s\u00eb qeras\u00eb s\u00eb n\u00ebnshkruar. Si pasoj\u00eb e moskthimit t\u00eb p\u00ebrgjigjes nga ana e bashkis\u00eb dhe me pretendimin q\u00eb i \u00ebsht\u00eb shkelur e drejta p\u00ebr informim,\u00a0 Grupi ATA i drejtohet Komisionerit p\u00ebr t\u00eb Drejt\u00ebn e Informimit n\u00ebp\u00ebrmjet ankes\u00ebs nr. 773 Prot., dt. 15.05.2019 duke i k\u00ebrkuar ushtrimin e kompetencave q\u00eb ia njeh ligji n\u00eb rastet e refuzimit t\u00eb p\u00ebrgjigjes nga institucioni kompetent.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Koordinatori i t\u00eb drejt\u00ebs p\u00ebr informim pran\u00eb Bashkis\u00eb Kam\u00ebz, n\u00ebp\u00ebrmjet nj\u00eb komunikimi elektronik lajm\u00ebron institucionin e Komisionerit q\u00eb k\u00ebrkesa n\u00eb fjal\u00eb nuk figuron e regjistruar pran\u00eb protokollit t\u00eb Bashkis\u00eb. Si pasoj\u00eb e kompleksitetit t\u00eb ngjarjes, Komisioneri pasi v\u00ebrteton n\u00ebp\u00ebrmjet post\u00ebs dhe hetimit administrativ q\u00eb shkresa ka mb\u00ebrritur n\u00eb zyrat e bashkis\u00eb dhe \u00ebsht\u00eb marr\u00eb n\u00eb ngarkim nga zyra e protokollit, p\u00ebrcakton dhe nj\u00eb seanc\u00eb d\u00ebgjimore mes pal\u00ebve t\u00eb interesuar. K\u00ebrkesa e d\u00ebrguar gjurmohet dhe rezulton se \u00ebsht\u00eb marr\u00eb nga nj\u00eb prej punonj\u00ebseve t\u00eb bashkis\u00eb, por p\u00ebr arsye q\u00eb nuk dihen personi p\u00ebrgjegj\u00ebs nuk e ka administruar at\u00eb n\u00ebp\u00ebrmjet regjistrimit n\u00eb regjistrin e protokollit, duke mos v\u00ebn\u00eb n\u00eb dijeni Koordinatorin e t\u00eb Drejt\u00ebs s\u00eb Informimit. P\u00ebr shkak t\u00eb k\u00ebsaj, Komisioneri n\u00eb vendimin e tij argumenton se personi p\u00ebrgjegj\u00ebs ka marr\u00eb p\u00ebrsip\u00ebr <em>ad hoc<\/em> funksionet e Koordinatorit, dhe ka manovruar me q\u00ebllim q\u00eb t\u00eb shmang\u00eb llogaridh\u00ebnien institucionale, e cila n\u00eb fakt p\u00ebrb\u00ebn nj\u00eb nga q\u00ebllimet kryesore t\u00eb s\u00eb drejt\u00ebs s\u00eb informimit. Ndaj, pas nj\u00eb vler\u00ebsimi \u00a0t\u00eb situat\u00ebs dhe fakteve t\u00eb mbledhura, me dt. 12.06.2019 Komisioneri merr vendimin e vendosjes s\u00eb sanksionit administrativ me gjob\u00eb n\u00eb shum\u00ebn e 150 000 lek\u00eb ndaj personit p\u00ebrgjegj\u00ebs n\u00eb Bashki.<\/span><br \/><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\"><a href=\"http:\/\/www.nyje.al\/wp-content\/uploads\/2019\/06\/vendimi2.png\"><img decoding=\"async\" class=\"size-full wp-image-2224 alignleft\" src=\"http:\/\/www.nyje.al\/wp-content\/uploads\/2019\/06\/vendimi2.png\" alt=\"\" width=\"631\" height=\"554\" \/><\/a><\/span><\/p><p>\u00a0<\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Nd\u00ebrkoh\u00eb \u00ebsht\u00eb gjithashtu n\u00eb proces shqyrtimi ankimi i rradh\u00ebs mbi refuzimin e nj\u00eb serie k\u00ebrkesash p\u00ebr informacion t\u00eb adresuara n\u00eb koh\u00eb nga grupi ATA, e q\u00eb do t\u00eb shqyrtohet n\u00eb seanc\u00ebn e dat\u00ebs 4 korrik 2019 n\u00eb pranin\u00eb e Komisionerit p\u00ebr t\u00eb Drejt\u00ebn e Informimit.<\/span><br \/><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Me vend do t\u00eb ishte reflektimi q\u00eb \u00e7far\u00eb fitohet kur nuk goditet mosfunksionimi i procesit t\u00eb rregullt t\u00eb pun\u00ebs s\u00eb administrat\u00ebs n\u00ebse nuk i shkohet n\u00eb rr\u00ebnj\u00eb problemit dhe nuk identifikohet p\u00ebrgjegj\u00ebsi i v\u00ebrtet\u00eb i \u201curdh\u00ebrit t\u00eb madh\u201d. Debatet mes \u201cintencionalist\u00ebve\u201d dhe \u201cfunksionalist\u00ebve\u201d kan\u00eb ekzistuar mes historian\u00ebve t\u00eb projekteve gjenocidale, dhe vazhdojn\u00eb edhe sot. Nj\u00ebra pal\u00eb ia atribuon iden\u00eb dhe vendimin e prer\u00eb nj\u00eb personi t\u00eb vet\u00ebm, e q\u00eb p\u00ebr t\u2019u realizuar priten vet\u00ebm plot\u00ebsimi i disa kushteve t\u00eb tjera. Burokracia nuk ka nevoj\u00eb p\u00ebr gj\u00eb tjet\u00ebr p\u00ebrve\u00e7se p\u00ebr p\u00ebrkufizimin e detyr\u00ebs s\u00eb saj. P\u00ebrfundimi i detyr\u00ebs mund t\u2019i besohet leht\u00ebsisht racionalitetit dhe efikasitetit t\u00eb burokrat\u00ebve. K\u00ebto k\u00ebrkesa, mb\u00ebshtetur n\u00eb ligjin p\u00ebr t\u00eb drejt\u00ebn e informimit kan\u00eb qen\u00eb t\u00eb fushave t\u00eb ndryshme, nd\u00ebr t\u00eb tjera informacione bazike mbi takimet dhe konsultimet publike, mbledhjet dhe vendimet e k\u00ebshillit bashkiak t\u00eb Kamz\u00ebs, marr\u00ebveshjet dhe kontratat e lidhura mes bashkis\u00eb dhe subjekteve private, kalendar\u00ebt e aktiviteteve kulturore, investimet infrastrukturore n\u00eb qytet etj.Pavar\u00ebsisht k\u00ebmb\u00ebnguljes s\u00eb grupit ATA p\u00ebr t\u00eb aksesuar informacione q\u00eb pa t\u00eb drejt\u00eb jan\u00eb mohohuar n\u00eb koh\u00eb, tendenca e bashkis\u00eb, Koordinatorit t\u00eb s\u00eb Drejt\u00ebs p\u00ebr Informim si dhe personave p\u00ebrgjegj\u00ebs p\u00ebr protokollimin e k\u00ebrkesave t\u00eb qytetar\u00ebve ka qen\u00eb neglizhuese e mohuese duke keqp\u00ebrdorur t\u00eb gjitha hap\u00ebsirat ligjore apo leht\u00ebsirat e krijuara pas seancave d\u00ebgjimore t\u00eb zhvilluara n\u00eb prani t\u00eb Komisionerit p\u00ebr t\u00eb drejt\u00ebn e Informimit, duke mohuar n\u00ebp\u00ebrmjet vones\u00ebs apo refuzimit nj\u00eb nga t\u00eb drejtat kushtetuese t\u00eb njeriut: e drejta p\u00ebr t\u2019u informuar. Me dat\u00eb 21 shkurt t\u00eb vitit 2019, Grupi ATA i drejtohet bashkis\u00eb Kam\u00ebz me k\u00ebrkes\u00ebn p\u00ebr informacion mbi nj\u00eb nga ngjarjet m\u00eb t\u00eb ndjeshme mjedisore p\u00ebr banor\u00ebt e Laknasit, tjet\u00ebrsimit dhe dh\u00ebnies me qera t\u00eb zon\u00ebs pyjore \u201cPlepat e Bruk\u00ebs\u201d ndaj nj\u00eb subjekti tregtar, q\u00eb kishte q\u00ebllime biznesi. Objekt i k\u00ebrkes\u00ebs ishte v\u00ebnia n\u00eb dispozicion t\u00eb vendimit t\u00eb k\u00ebshillit bashkiak me t\u00eb cilin zona e ashtuquajtur \u201cPlepat e Bruk\u00ebs\u201d i jepej me qera nga Bashkia Kam\u00ebz subjektit privat tregtar \u201cBIOPRODUCTS\u201d shpk, si dhe bashkangjitur nj\u00eb kopje e kontrat\u00ebs s\u00eb qiras\u00eb mes kryetarit t\u00eb bashkis\u00eb Xhelal Mziut dhe subjektit \u201cBIOPRODUCTS\u201d shpk.Rreth dy muaj m\u00eb pas, m\u00eb 24 prill, p\u00ebr shkak t\u00eb pamund\u00ebsis\u00eb p\u00ebr t\u00eb siguruar informacionin e k\u00ebrkuar n\u00eb rrug\u00eb zyrtare q\u00eb me k\u00ebrkes\u00eb t\u00eb par\u00eb, rip\u00ebrs\u00ebritet k\u00ebrkesa me t\u00eb nj\u00ebjtin objekt duke k\u00ebrkuar vendimin e k\u00ebshillit bashkiak p\u00ebr miratimin e dh\u00ebnies me qira t\u00eb zon\u00ebs pyjore \u201cPlepat e Bruk\u00ebs\u201d si dhe kopje e kontrat\u00ebs s\u00eb qeras\u00eb s\u00eb n\u00ebnshkruar. Si pasoj\u00eb e moskthimit t\u00eb p\u00ebrgjigjes nga ana e bashkis\u00eb dhe me pretendimin q\u00eb i \u00ebsht\u00eb shkelur e drejta p\u00ebr informim,\u00a0 Grupi ATA i drejtohet Komisionerit p\u00ebr t\u00eb Drejt\u00ebn e Informimit n\u00ebp\u00ebrmjet ankes\u00ebs nr. 773 Prot., dt. 15.05.2019 duke i k\u00ebrkuar ushtrimin e kompetencave q\u00eb ia njeh ligji n\u00eb rastet e refuzimit t\u00eb p\u00ebrgjigjes nga institucioni kompetent. Koordinatori i t\u00eb drejt\u00ebs p\u00ebr informim pran\u00eb Bashkis\u00eb Kam\u00ebz, n\u00ebp\u00ebrmjet nj\u00eb komunikimi elektronik lajm\u00ebron institucionin e Komisionerit q\u00eb k\u00ebrkesa n\u00eb fjal\u00eb nuk figuron e regjistruar pran\u00eb protokollit t\u00eb Bashkis\u00eb. Si pasoj\u00eb e kompleksitetit t\u00eb ngjarjes, Komisioneri pasi v\u00ebrteton n\u00ebp\u00ebrmjet post\u00ebs dhe hetimit administrativ q\u00eb shkresa ka mb\u00ebrritur n\u00eb zyrat e bashkis\u00eb dhe \u00ebsht\u00eb marr\u00eb n\u00eb ngarkim nga zyra e protokollit, p\u00ebrcakton dhe nj\u00eb seanc\u00eb d\u00ebgjimore mes pal\u00ebve t\u00eb interesuar. P\u00ebrgjat\u00eb seanc\u00ebs s\u00eb zhvilluar m\u00eb 05.06.2019, p\u00ebrfaq\u00ebsuesi i Autoritetit Publik v\u00eb n\u00eb dispozicion t\u00eb ankuesve informacionin e k\u00ebrkuar, duke p\u00ebrmbyllur k\u00ebshtu ciklin e marrjes s\u00eb informacionit i cili n\u00eb vend se t\u00eb zgjaste 10 dit\u00eb sipas parashikimeve ligjore, u mund\u00ebsua n\u00eb 5 muaj p\u00ebr shkak t\u00eb vonesave t\u00eb q\u00ebllimshme t\u00eb bashkis\u00eb. Pjes\u00eb e shk\u00ebputur nga vendimi i Komisionerit p\u00ebr t\u00eb drejt\u00ebn p\u00ebr Informim Edhe pse n\u00eb fakt dukej e ezauruar k\u00ebrkesa p\u00ebr informacion, procesi i hetimit administrativ nxjerr n\u00eb pah keqfunksionimin e procesit t\u00eb pun\u00ebs pran\u00eb bashkis\u00eb. K\u00ebrkesa e d\u00ebrguar gjurmohet dhe rezulton se \u00ebsht\u00eb marr\u00eb nga nj\u00eb prej punonj\u00ebseve t\u00eb bashkis\u00eb, por p\u00ebr arsye q\u00eb nuk dihen personi p\u00ebrgjegj\u00ebs nuk e ka administruar at\u00eb n\u00ebp\u00ebrmjet regjistrimit n\u00eb regjistrin e protokollit, duke mos v\u00ebn\u00eb n\u00eb dijeni Koordinatorin e t\u00eb Drejt\u00ebs s\u00eb Informimit. P\u00ebr shkak t\u00eb k\u00ebsaj, Komisioneri n\u00eb vendimin e tij argumenton se personi p\u00ebrgjegj\u00ebs ka marr\u00eb p\u00ebrsip\u00ebr ad hoc funksionet e Koordinatorit, dhe ka manovruar me q\u00ebllim q\u00eb t\u00eb shmang\u00eb llogaridh\u00ebnien institucionale, e cila n\u00eb fakt p\u00ebrb\u00ebn nj\u00eb nga q\u00ebllimet kryesore t\u00eb s\u00eb drejt\u00ebs s\u00eb informimit.
