Procesi gjyq\u00ebsor i shkall\u00ebs s\u00eb par\u00eb, i filluar q\u00eb prej vitit 2019, u dha t\u00eb drejt\u00eb banor\u00ebve n\u00eb pretendimet e tyre p\u00ebr paligjshm\u00ebrin\u00eb e bashkis\u00eb Kam\u00ebz dhe kompanis\u00eb private n\u00eb projektin e nd\u00ebrtimit t\u00eb nj\u00eb thertoreje n\u00eb zon\u00ebn e Plepave t\u00eb Bruk\u00ebs.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Beteja e Plepave t\u00eb Bruk\u00ebs, daton q\u00eb prej janarit t\u00eb vitit 2019, vit n\u00eb t\u00eb cilin Bashkia Kam\u00ebz jep me qera p\u00ebr nj\u00eb periudh\u00eb 20 vje\u00e7are sip\u00ebrfaqen prej 12.400 m2\u00a0\u00a0t\u00eb Plepave t\u00eb Bruk\u00ebs, n\u00eb vler\u00ebn e 110,000,000 lek\u00ebsh. N\u00eb kontrat\u00eb parashikohej nd\u00ebrtimi i nj\u00eb objekti i cili do t\u00eb kishte si aktivitet mbar\u00ebshtim t\u00eb kafsh\u00ebve, thertore, shitje blerje l\u00ebkurash, tregti e kafsh\u00ebve t\u00eb gjalla. Kjo kontrat\u00eb qeraje nuk u zbatua asnj\u00ebher\u00eb, kjo prej rezistenc\u00ebs s\u00eb fort\u00eb t\u00eb banor\u00ebve t\u00eb zon\u00ebs dhe mas\u00ebs s\u00eb sigurimit t\u00eb padis\u00eb q\u00eb n\u00eb fillim t\u00eb procesit gjyq\u00ebsor.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">N\u00eb konkluzionet p\u00ebrfundimtare t\u00eb parashtruara nga avokatja Ndreka, \u00ebsht\u00eb risjell\u00eb n\u00eb v\u00ebmendje k\u00ebrkesa kryesore p\u00ebr konstatimin e pavlefshm\u00ebris\u00eb absolute te Vler\u00ebsimit t\u00eb Ndikimit n\u00eb Mjedis, si dhe t\u00eb akteve t\u00eb lejes se mjedisit dhe lejes s\u00eb nd\u00ebrtimit t\u00eb l\u00ebshuara nga Bashkia Kam\u00ebz n\u00eb vitin 2019. Zona e \u201cPlepave t\u00eb Bruk\u00ebs\u2019 e regjistruar n\u00eb z\u00ebrin kadastral t\u00eb bashkis\u00eb si \u2018tok\u00eb zallishte\u2019 \u00ebsht\u00eb kultivuar p\u00ebrgjat\u00eb 30 viteve nga vet\u00eb banor\u00ebt e zon\u00ebs me pem\u00eb frutore dhe zbukuruese dhe bim\u00ebsi t\u00eb tjera t\u00eb dendura t\u00eb cilat ia kan\u00eb p\u00ebrmir\u00ebsuar jetes\u00ebn familjeve p\u00ebrreth duke krijuar k\u00ebshtu pyllin per te gjithe zonen e Laknasit.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Sipas Planit t\u00eb Detajuar Vendor, n\u00eb at\u00eb zon\u00eb specifike nuk \u00ebsht\u00eb e lejuar t\u00eb nd\u00ebrtohen stabilimente thertoresh apo hap\u00ebsira p\u00ebr mbar\u00ebshtim kafsh\u00ebsh, dhe asnj\u00eb aktivitet q\u00eb ka ndikim t\u00eb lart\u00eb n\u00eb mjedis. Sipas raportit p\u00ebr miratimin e VNM-s\u00eb vihet n\u00eb dukje se aktiviteti i parashikuar p\u00ebr nd\u00ebrtim kishte ndikim shum\u00eb t\u00eb lart\u00eb n\u00eb mjedis, i cili, ndryshe nga sa pretendonte pala e paditur, do t\u00eb isht\u00eb i parikuperuesh\u00ebm pas nd\u00ebrtimit t\u00eb objektit.<\/span><br \/><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Parregullsi dhe mang\u00ebsi t\u00eb theksuara profesionale jan\u00eb gjetur po ashtu n\u00eb raportin e Vler\u00ebsimit t\u00eb Ndikimit n\u00eb Mjedis, i cili sipas padit\u00ebsave p\u00ebrmbante informacion t\u00eb par\u00ebnd\u00ebsish\u00ebm duke p\u00ebrfshir\u00eb t\u00eb dh\u00ebna edhe mbi monumentet natyrore t\u00eb Tiran\u00ebs dhe ve\u00e7ori t\u00eb lumenjve t\u00eb ndrysh\u00ebm t\u00eb Shqip\u00ebris\u00eb, duke shkuar deri te lumi Vjos\u00eb dhe Valbon\u00eb, raste aspak relevante p\u00ebr zon\u00ebn e Laknasit, pjes\u00eb e bashkis\u00eb Kam\u00ebz.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Leja e zhvillimit dhe leja e nd\u00ebrtimit jan\u00eb dy dokumente t\u00eb cilat jan\u00eb dh\u00ebn\u00eb n\u00eb kund\u00ebrshtim t\u00eb hapur me ligjin dhe jasht\u00eb kompetencave t\u00eb Bashkis\u00eb Kam\u00ebz dhe ky q\u00ebndrim \u00ebsht\u00eb mb\u00ebshtetur edhe nga Gjykata sot. K\u00ebto jan\u00eb pretendime q\u00eb jan\u00eb ngritur q\u00eb n\u00eb fillim t\u00eb procesit gjyq\u00ebsor dhe jan\u00eb konsideruar t\u00eb bazuara n\u00eb ligj dhe n\u00eb fakte edhe nga gjykata. K\u00ebto dokumente jan\u00eb l\u00ebshuar gjat\u00eb vitit 2019, n\u00eb at\u00eb koh\u00eb n\u00ebn drejtimin e ish-kryetarit t\u00eb bashkis\u00eb Xhelal Mziut. Situata e banor\u00ebve nuk ka ndryshuar, p\u00ebrkundrazi \u00ebsht\u00eb p\u00ebrkeq\u00ebsuar pas ardhjes s\u00eb kryetarit t\u00eb krahut t\u00eb majt\u00eb, Rakip Suli, kjo p\u00ebr shkak t\u00eb rritjes s\u00eb tensionimeve n\u00eb terren mes banor\u00ebve dhe firm\u00ebs private, dhe munges\u00ebs s\u00eb nd\u00ebrhyrjes nga ana e bashkis\u00eb. Kryetari aktual, me retorik\u00eb p\u00ebrkrah\u00ebse, por e pamb\u00ebshtetur n\u00eb akte konkrete, nuk ka pasur vullnetin politik p\u00ebr t\u00eb mbrojtur zon\u00ebn e Plepave t\u00eb Bruk\u00ebs. N\u00eb nj\u00eb nga mbledhjet e k\u00ebshillit bashkiak, me pranin\u00eb e kryetarit t\u00eb bashkis\u00eb dhe kryetarit t\u00eb k\u00ebshillit, t\u00eb dy jan\u00eb shprehur se nuk munden ta shpallin zon\u00ebn e Plepave t\u00eb Bruk\u00ebs si zon\u00eb pyjore si\u00e7 pretendojn\u00eb banor\u00ebt, p\u00ebr shkak t\u00eb procesit gjyq\u00ebsor q\u00eb po zhvillohej. Nd\u00ebrkoh\u00eb, sipas parashikimeve ligjore, K\u00ebshilli Bashkiak i Kamz\u00ebs mund ta shpallte zon\u00ebn n\u00eb fjal\u00eb \u2018pyll\u2019 duke i garantuar nj\u00ebher\u00eb e p\u00ebrgjithmon\u00eb mbrojtje m\u00eb t\u00eb lart\u00eb zon\u00ebs, krahasimisht me mbrojtjen q\u00eb g\u00ebzon ajo sot.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Nj\u00eb argument shum\u00eb i r\u00ebnd\u00ebsish\u00ebm i parashtruar nga banor\u00ebt n\u00eb protesta t\u00eb shumta dhe q\u00eb \u00ebsht\u00eb artikuluar gjithashtu n\u00eb procesin gjyq\u00ebsor \u00ebsht\u00eb se te Plepat e Bruk\u00ebs sipas VKM-s\u00eb nr 686 \u201c<em><i>P\u00ebr miratimin e Rregullores s\u00eb Planifikimit t\u00eb Territorit<\/i><\/em>\u201d nuk duhet lejuar zhvillimi i asnj\u00eb aktiviteti privat dhe po ashtu, asnj\u00eb lloj nd\u00ebrtimi me p\u00ebrjashtim t\u00eb atyre q\u00eb kan\u00eb si q\u00ebllim ruajtjen e pyllit.<\/span><br \/><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Argumenti i fundit dhe m\u00eb i r\u00ebnd\u00ebsish\u00ebm i ngritur n\u00eb procesin gjyq\u00ebsor nga ana e banor\u00ebve ishte se \u2018Plepat e Bruk\u00ebs\u201d nuk ishte \u2018zallishte\u2019 por pyll. Ekspert\u00ebt gjat\u00eb gjith\u00eb procesit gjyq\u00ebsor kan\u00eb vonuar aktet e ekspertimit duke shkaktuar tejzgjatje t\u00eb pajustifikueshme t\u00eb procesit. N\u00eb nj\u00eb prej seancave t\u00eb zhvilluara ata jan\u00eb <a href=\"https:\/\/nyje.al\/sq\/ekspertet-nuk-kryejne-detyren-plepat-e-brukes-zvarritet-ne-sallat-e-gjykates\/\"><u>gjobitur <\/u><\/a>nga gjyqtari Ka\u00e7kini. Akti i fundit i ekspertimit ka nxjerr\u00eb se te Plepat e Bruk\u00ebs ndodhen 1636 pem\u00eb dhe zona \u00ebsht\u00eb e mbuluar me pem\u00eb t\u00eb larta n\u00eb 20% t\u00eb hap\u00ebsir\u00ebs s\u00eb saj.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Pretendimet e banor\u00ebve jan\u00eb se kjo p\u00ebrqindje faktikisht arrin deri n\u00eb 70% t\u00eb mbulimit, po t\u00eb merreshin n\u00eb konsiderat\u00eb edhe pem\u00ebt q\u00eb kan\u00eb nj\u00eb gjat\u00ebsi prej 5m, megjithat\u00eb edhe me k\u00ebto t\u00eb dh\u00ebna, sipas p\u00ebrkufizimit t\u00eb ligjit shqiptar, \u201cPlepat e Bruk\u00ebs\u201d kategorizohet si pyll. Aktet e ekspertimit sipas Av. Ndreka gjithashtu kan\u00eb probleme t\u00eb tjera ligjore pasi ekspert\u00ebt kan\u00eb shkelur parashikimet e Kodit t\u00eb Procedur\u00ebs Civile. Ata kan\u00eb formuluar q\u00ebndrime juridike n\u00eb aktet e tyre, n\u00eb vend se t\u00eb mjaftoheshin vet\u00ebm me pohime shkencore dhe teknike q\u00eb lidhen me ekspertimin mjedisor q\u00eb do t\u00eb duhej t\u00eb kryenin.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Sipas avokat\u00ebve, vendimi i shpallur sot nga Gjykata Administrative e Shkall\u00ebs s\u00eb Par\u00eb ka afat t\u00eb ankimohet nga pal\u00ebt humb\u00ebse brenda 15 dit\u00ebve, por e vler\u00ebsojn\u00eb thuajse t\u00eb pamundur q\u00eb firma private \u2018Bioproducts\u2019 shpk dhe Bashkia Kam\u00ebz t\u00eb arrijn\u00eb t\u00eb fitojn\u00eb procesin n\u00eb shkall\u00eb t\u00eb tjera. Momentalisht, zona e Plepave t\u00eb Bruk\u00ebs \u00ebsht\u00eb e mbrojtur edhe nga vendimi i Gjykat\u00ebs s\u00eb Lart\u00eb i cili ka l\u00ebn\u00eb n\u00eb fuqi vendimin e shkall\u00ebs s\u00eb par\u00eb p\u00ebr sigurimin e padis\u00eb.<\/span><\/p><p style=\"text-align: justify\"><span style=\"font-family: georgia, palatino, serif;font-size: 14pt\">Banor\u00ebt,si n\u00eb \u00e7do seanc\u00eb tjet\u00ebr t\u00eb pranish\u00ebm edhe sot n\u00eb oborrin e Gjykat\u00ebs, kan\u00eb g\u00ebzuar mes nj\u00ebri-tjetrit lajmin e fitores. N\u00eb konkluzionet p\u00ebrfundimtare t\u00eb parashtruara nga avokatja Ndreka, \u00ebsht\u00eb risjell\u00eb n\u00eb v\u00ebmendje k\u00ebrkesa kryesore p\u00ebr konstatimin e pavlefshm\u00ebris\u00eb absolute te Vler\u00ebsimit t\u00eb Ndikimit n\u00eb Mjedis, si dhe t\u00eb akteve t\u00eb lejes se mjedisit dhe lejes s\u00eb nd\u00ebrtimit t\u00eb l\u00ebshuara nga Bashkia Kam\u00ebz n\u00eb vitin 2019. Zona e \u201cPlepave t\u00eb Bruk\u00ebs\u2019 e regjistruar n\u00eb z\u00ebrin kadastral t\u00eb bashkis\u00eb si \u2018tok\u00eb zallishte\u2019 \u00ebsht\u00eb kultivuar p\u00ebrgjat\u00eb 30 viteve nga vet\u00eb banor\u00ebt e zon\u00ebs me pem\u00eb frutore dhe zbukuruese dhe bim\u00ebsi t\u00eb tjera t\u00eb dendura t\u00eb cilat ia kan\u00eb p\u00ebrmir\u00ebsuar jetes\u00ebn familjeve p\u00ebrreth duke krijuar k\u00ebshtu pyllin per te gjithe zonen e Laknasit. Sipas Planit t\u00eb Detajuar Vendor, n\u00eb at\u00eb zon\u00eb specifike nuk \u00ebsht\u00eb e lejuar t\u00eb nd\u00ebrtohen stabilimente thertoresh apo hap\u00ebsira p\u00ebr mbar\u00ebshtim kafsh\u00ebsh, dhe asnj\u00eb aktivitet q\u00eb ka ndikim t\u00eb lart\u00eb n\u00eb mjedis. Sipas raportit p\u00ebr miratimin e VNM-s\u00eb vihet n\u00eb dukje se aktiviteti i parashikuar p\u00ebr nd\u00ebrtim kishte ndikim shum\u00eb t\u00eb lart\u00eb n\u00eb mjedis, i cili, ndryshe nga sa pretendonte pala e paditur, do t\u00eb isht\u00eb i parikuperuesh\u00ebm pas nd\u00ebrtimit t\u00eb objektit.Parregullsi dhe mang\u00ebsi t\u00eb theksuara profesionale jan\u00eb gjetur po ashtu n\u00eb raportin e Vler\u00ebsimit t\u00eb Ndikimit n\u00eb Mjedis, i cili sipas padit\u00ebsave p\u00ebrmbante informacion t\u00eb par\u00ebnd\u00ebsish\u00ebm duke p\u00ebrfshir\u00eb t\u00eb dh\u00ebna edhe mbi monumentet natyrore t\u00eb Tiran\u00ebs dhe ve\u00e7ori t\u00eb lumenjve t\u00eb ndrysh\u00ebm t\u00eb Shqip\u00ebris\u00eb, duke shkuar deri te lumi Vjos\u00eb dhe Valbon\u00eb, raste aspak relevante p\u00ebr zon\u00ebn e Laknasit, pjes\u00eb e bashkis\u00eb Kam\u00ebz. Leja e zhvillimit dhe leja e nd\u00ebrtimit jan\u00eb dy dokumente t\u00eb cilat jan\u00eb dh\u00ebn\u00eb n\u00eb kund\u00ebrshtim t\u00eb hapur me ligjin dhe jasht\u00eb kompetencave t\u00eb Bashkis\u00eb Kam\u00ebz dhe ky q\u00ebndrim \u00ebsht\u00eb mb\u00ebshtetur edhe nga Gjykata sot. K\u00ebto dokumente jan\u00eb l\u00ebshuar gjat\u00eb vitit 2019, n\u00eb at\u00eb koh\u00eb n\u00ebn drejtimin e ish-kryetarit t\u00eb bashkis\u00eb Xhelal Mziut. N\u00eb nj\u00eb nga mbledhjet e k\u00ebshillit bashkiak, me pranin\u00eb e kryetarit t\u00eb bashkis\u00eb dhe kryetarit t\u00eb k\u00ebshillit, t\u00eb dy jan\u00eb shprehur se nuk munden ta shpallin zon\u00ebn e Plepave t\u00eb Bruk\u00ebs si zon\u00eb pyjore si\u00e7 pretendojn\u00eb banor\u00ebt, p\u00ebr shkak t\u00eb procesit gjyq\u00ebsor q\u00eb po zhvillohej. Nd\u00ebrkoh\u00eb, sipas parashikimeve ligjore, K\u00ebshilli Bashkiak i Kamz\u00ebs mund ta shpallte zon\u00ebn n\u00eb fjal\u00eb \u2018pyll\u2019 duke i garantuar nj\u00ebher\u00eb e p\u00ebrgjithmon\u00eb mbrojtje m\u00eb t\u00eb lart\u00eb zon\u00ebs, krahasimisht me mbrojtjen q\u00eb g\u00ebzon ajo sot. Nj\u00eb argument shum\u00eb i r\u00ebnd\u00ebsish\u00ebm i parashtruar nga banor\u00ebt n\u00eb protesta t\u00eb shumta dhe q\u00eb \u00ebsht\u00eb artikuluar gjithashtu n\u00eb procesin gjyq\u00ebsor \u00ebsht\u00eb se te Plepat e Bruk\u00ebs sipas VKM-s\u00eb nr 686 \u201cP\u00ebr miratimin e Rregullores s\u00eb Planifikimit t\u00eb Territorit\u201d nuk duhet lejuar zhvillimi i asnj\u00eb aktiviteti privat dhe po ashtu, asnj\u00eb lloj nd\u00ebrtimi me p\u00ebrjashtim t\u00eb atyre q\u00eb kan\u00eb si q\u00ebllim ruajtjen e pyllit.Argumenti i fundit dhe m\u00eb i r\u00ebnd\u00ebsish\u00ebm i ngritur n\u00eb procesin gjyq\u00ebsor nga ana e banor\u00ebve ishte se \u2018Plepat e Bruk\u00ebs\u201d nuk ishte \u2018zallishte\u2019 por pyll. Ekspert\u00ebt gjat\u00eb gjith\u00eb procesit gjyq\u00ebsor kan\u00eb vonuar aktet e ekspertimit duke shkaktuar tejzgjatje t\u00eb pajustifikueshme t\u00eb procesit. N\u00eb nj\u00eb prej seancave t\u00eb zhvilluara ata jan\u00eb gjobitur nga gjyqtari Ka\u00e7kini. Akti i fundit i ekspertimit ka nxjerr\u00eb se te Plepat e Bruk\u00ebs ndodhen 1636 pem\u00eb dhe zona \u00ebsht\u00eb e mbuluar me pem\u00eb t\u00eb larta n\u00eb 20% t\u00eb hap\u00ebsir\u00ebs s\u00eb saj. Pretendimet e banor\u00ebve jan\u00eb se kjo p\u00ebrqindje faktikisht arrin deri n\u00eb 70% t\u00eb mbulimit, po t\u00eb merreshin n\u00eb konsiderat\u00eb edhe pem\u00ebt q\u00eb kan\u00eb nj\u00eb gjat\u00ebsi prej 5m, megjithat\u00eb edhe me k\u00ebto t\u00eb dh\u00ebna, sipas p\u00ebrkufizimit t\u00eb ligjit shqiptar, \u201cPlepat e Bruk\u00ebs\u201d kategorizohet si pyll. Aktet e ekspertimit sipas Av. Ndreka gjithashtu kan\u00eb probleme t\u00eb tjera ligjore pasi ekspert\u00ebt kan\u00eb shkelur parashikimet e Kodit t\u00eb Procedur\u00ebs Civile. Ata kan\u00eb formuluar q\u00ebndrime juridike n\u00eb aktet e tyre, n\u00eb vend se t\u00eb mjaftoheshin vet\u00ebm me pohime shkencore dhe teknike q\u00eb lidhen me ekspertimin mjedisor q\u00eb do t\u00eb duhej t\u00eb kryenin. Sipas avokat\u00ebve, vendimi i shpallur sot nga Gjykata Administrative e Shkall\u00ebs s\u00eb Par\u00eb ka afat t\u00eb ankimohet nga pal\u00ebt humb\u00ebse brenda 15 dit\u00ebve, por e vler\u00ebsojn\u00eb thuajse t\u00eb pamundur q\u00eb firma private \u2018Bioproducts\u2019 shpk dhe Bashkia Kam\u00ebz t\u00eb arrijn\u00eb t\u00eb fitojn\u00eb procesin n\u00eb shkall\u00eb t\u00eb tjera. Momentalisht, zona e Plepave t\u00eb Bruk\u00ebs \u00ebsht\u00eb e mbrojtur edhe nga vendimi i Gjykat\u00ebs s\u00eb Lart\u00eb i cili ka l\u00ebn\u00eb n\u00eb fuqi vendimin e shkall\u00ebs s\u00eb par\u00eb p\u00ebr sigurimin e padis\u00eb.
